Terms & Conditions

MBIZI lagoon house, Version: 01.03.2026

1. Contracting Parties

The contracting parties for the rental of the holiday home MBIZI lagoon house are:

Angela Krüger & Christian Ohler, Schürfeld 19, 45470 Mülheim an der Ruhr, info@mbizilagoonhouse.com

(hereinafter referred to as "Landlord")

2. Subject Matter of the Contract

  1. The high-quality furnished holiday home MBIZI lagoon house, including garden, pool, terrace, outdoor facilities, and inventory, is rented for temporary private use.
  2. The maximum number of persons stated in the booking confirmation must not be exceeded.
  3. The following are not permitted without the written consent of the Landlords:
    • Parties or events
    • Weddings
    • Commercial use
    • Film or photo productions
    • Subletting

A separate agreement is required for such uses.

3. Booking and Conclusion of Contract

  1. Bookings are made via the integrated booking system (e.g., Smoobu).
  2. By submitting the booking, the guest makes a binding offer.
  3. The contract is only concluded upon written booking confirmation via email – after receipt of the deposit.

4. Prices and Payment Terms

  1. The prices displayed in the booking system apply.
  2. Payment terms:
    • 30% deposit upon booking confirmation
    • 70% balance due no later than 30 days prior to arrival
  3. In the event of late payment, the landlord is entitled to withdraw from the contract.
  4. Payments can be made in EUR or ZAR. The exchange rate valid on the payment date applies.

5. Security Deposit

  1. A security deposit of ZAR 10,000 is required.
  2. The security deposit must be paid no later than 7 days prior to arrival.
  3. The deposit will be refunded within 14 days of departure, provided no damage or exceptional cleaning costs are noted.

6. Cancellation Policy

  • Up to 15 days prior to arrival: free of charge
  • Less than 14 days prior to arrival: the full amount paid is forfeited

The date of receipt of the written cancellation notice is decisive.
... We recommend taking out travel cancellation insurance.

7. Pre-registration and Security Information

For security and estate regulations, guests are required to submit the following information no later than 72 hours prior to arrival:

  • Full names of all travelers
  • Passport or ID numbers
  • Information on any accompanying children (including ages)
  • Vehicle registration number
  • Estimated arrival time

This data will be processed confidentially in accordance with applicable data protection laws.

Failure to submit this information on time may result in delayed or denied check-in.

8. Cleaning and Additional Services

  1. A one-time final cleaning fee is charged per stay and is shown separately in the booking system.
  2. For stays of 8 nights or more, a mid-stay cleaning with linen change is included.
  3. Additional cleaning services can be booked with at least 24 hours' notice for an additional fee.
  4. An additional cleaning fee may be charged for exceptionally heavy soiling.

9. Fair Use Policy for Electricity Consumption

  1. The rental price includes average daily electricity consumption of up to 30 kWh per day.
  2. Any consumption exceeding this will be charged separately at the local rate per kWh and can be deducted from the security deposit.

This policy is based on the sustainable use of the property and the specific energy infrastructure in South Africa.

10. South Africa-Specific Information

  1. Power outages ("load shedding"), water restrictions, or infrastructure limitations may occur.
  2. Such circumstances do not constitute a defect in the rental property. Claims for refunds arising from such circumstances are excluded.

11. Safety and Conduct Rules

  • Doors and windows must always be locked when leaving the property.
  • Alarm systems must be activated when not in use.
  • False alarms caused by improper operation may incur charges.
  • Pool use is at your own risk.
  • Children must be supervised at all times.
  • Smoking is prohibited indoors.
  • Open fires are prohibited.
  • Grilling/braai use is permitted only in the designated area.

In case of serious violations, the contract may be terminated without notice.

12. Liability

  • Unlimited liability applies in cases of intent and gross negligence.
  • In cases of slight negligence, liability applies only in the event of a breach of essential contractual obligations.
  • No liability is accepted for force majeure or governmental actions.
  • Use of the pool and outdoor facilities is at your own risk.

13. No Right of Withdrawal

There is no right of withdrawal pursuant to Section 312g Paragraph 2 No. 9 of the German Civil Code (BGB), as this is an accommodation service with a fixed date.

14. Applicable Law

German law applies, taking into account mandatory consumer protection regulations.

The place of performance is the location of the MBIZI lagoon house in South Africa.
